Terms & Conditions – Elite Foods Christmas Lucky Draw Contest 2025

1. Contest Period

   The “Christmas Contest” (hereinafter referred to as the Contest) will be active from 1st December 2025 to 15th January 2026, both days inclusive. Entries received outside this period will not be considered.

2. General

   • This contest (“Lucky Draw Contest”) is organized by Elite Foods India Pvt Ltd (“Organizer” or “Company”).
   • The contest is open only to permanent residents of the State of Kerala, aged 18 years and above.
   • Employees of Elite Foods Pvt. Ltd., its group companies, advertising agencies, contest partners, or vendors directly associated with the campaign, and their immediate family members — limited to parents, spouse, children, and siblings — shall not be eligible to participate in this contest.
   • Participation in the contest implies that the participant has read, understood, and accepted all the terms and conditions stated herein in full.
   • The Organizer reserves the right to make changes to these terms and conditions at any time without prior notice.
   • Participation in this contest constitutes acceptance of all the above terms and conditions.

3. Eligibility and Participation

   • To participate, customers must purchase any eligible Elite cake carrying the campaign QR code during the contest period.
   • The contest is valid only for purchases made within the offer period announced by the Organizer.
   • Each eligible purchase qualifies for one (1) entry into the Lucky Draw. Multiple scans or entries from the same bill for the same purchase are not permitted.
   • Participants must scan the campaign QR code using a mobile device and complete all required details including: Full Name, Mobile Number, WhatsApp Number, Address, City, and Pin Code.
   • Entry shall be valid only after successful SMS OTP verification.
   • Each participant is eligible to win only one (1) prize during the entire campaign.
   • The winners must submit a valid purchase bill/invoice clearly showing the date of purchase and the name of the product purchased in order to be eligible to receive the prize. In cases where a purchase bill is not issued by the retail outlet, participants shall be required to enter the name and location of the store along with the date of purchase while enrolling. The Organizer reserves the right to verify such details through internal records or cross-verification before confirming eligibility.
   • Incomplete, duplicate, or fraudulent entries will be automatically disqualified.

4. Prize Details

   • A total of 50 winners will be selected through a computerized random Lucky Draw from among the valid entries.
   • Each selected winner, or a person nominated by the winner, shall be entitled to receive a 3 kW Solar Power Plant, installed by the Company’s authorized partner, The Solgen Energy Pvt Ltd., subject to the provisions of Clause 6 below.
   • The installation will be subject to the winner’s site suitability, local electricity board approvals, and other applicable conditions.
   • The prize is non-transferable, non-exchangeable, and cannot be redeemed for cash or any other benefit.
   • The prize includes supply and installation of the solar power system as defined under Clause 6 below.
   • The Organizer reserves the right to substitute the prize with another item of equal or higher value in case of unforeseen circumstances.

5. Winner Announcement and Verification

   • Winners will be selected through a computerized random draw conducted by the Organizer.
   • The decision of Elite Foods Pvt. Ltd. shall be final and binding, and no correspondence or dispute regarding the same shall be entertained.
   • The list of winners will be published on the Company’s official website or social media handles within 15 working days of the contest closure.
   • Winners will be notified via their registered mobile number and/or WhatsApp.
   • Winners must provide valid photo ID and address proof (such as Aadhaar, Voter ID, or Passport) to claim the prize.
   • If a winner fails to respond or provide valid documents within the specified period, the prize will be forfeited and may be offered to another participant.
   • The Organizer reserves the right to verify participant details and disqualify entries found to be invalid or non-compliant.

6. Solar Power Plant Installation Terms

   • The 3 kW Solar Power Plant installation shall be carried out by the Company’s authorized partner, Solgen Energy Pvt Ltd, and will be governed by the following conditions:
   • Installation will be subject to technical feasibility and site inspection by the installation partner.
   • The winner must provide a shadow-free area suitable for mounting solar panels.
   • The Solar Power Plant shall be installed only at a property within the state of Kerala owned by the winner or by another person nominated by the winner, provided that: (a) the authorized person is the legal owner of the property located in Kerala; (b) the winner provides written authorization permitting installation in the nominee’s property; (c) valid ownership and address proofs of the nominee and property are submitted; and (d) the site passes inspection and technical approval from Solgen Energy Pvt Ltd.
   • Once installation is completed as per the winner’s written authorization, the prize shall be deemed delivered and accepted in full.
   • The Solar Power Plant will be installed in the name of a person holding a valid consumer number from the Electricity Department (KSEB).
   • All Net Metering, statutory approvals, and fees (including KSEB feasibility fees, registration fees, and load enhancement fees) shall be borne by the customer/winner.
   • The structure for installation shall be treated as a flat concrete roof. Any modifications or additional structures required will be under the customer’s cost and responsibility.
   • Insurance after installation will be under the customer’s responsibility.
   • The system carries a back-to-back warranty of 5 years for manufacturing defects and a 25-year performance warranty for the solar PV modules, as provided by the manufacturer.
   • The Organizer’s responsibility is limited to facilitating installation through its authorized partner. Any service, warranty, or maintenance issues after handover shall be directly between the customer and Solgen Energy Pvt Ltd.

7. Tax Deduction at Source (TDS)

   The winner shall make remittance of an amount equivalent to the TDS at the rate of 31.2% for the value of the gift received as per prevailing law under Section 194B of the Income Tax Act to Elite Foods Pvt. Ltd. The corresponding TDS certificate shall be issued by the Organizer within the stipulated time (if valid PAN is provided), enabling the winner to claim the same against their tax liability. If the winner disagrees to pay the applicable TDS amount, the prize will be forfeited and Elite shall not be liable for any further claim.

8. Organizer’s Rights and Liabilities

   • The Organizer reserves the right to modify, suspend, or cancel the contest at any time without prior notice.
   • The Organizer’s decision in all matters relating to the contest shall be final and binding on all participants.
   • The Organizer shall not be responsible for:
     • (a) technical failures, network issues, or system errors beyond its control;
     • (b) any disputes between the winner and/or the authorized person and the installation partner;
     • (c) delays or inability to install the system due to government or site restrictions; and
     • (d) loss, damage, or injury arising directly or indirectly from participation or use of the prize.
   • Any statutory levy, local approval, or incidental expense shall be borne by the winner unless otherwise stated.

9. Data Privacy

   • All personal information collected will be used solely for the administration of this campaign and for contacting winners.
   • The data will not be shared with any third party, except for the installation partner for prize fulfillment purposes.
   • By participating, entrants consent to the use of their name, photograph, and entry details by the Organizer for promotional purposes related to this campaign, without further compensation.

10. Dispute Resolution

    • Any disputes, claims, or complaints arising out of or in connection with this contest shall be subject to the exclusive jurisdiction of the courts at Thrissur, Kerala, India.
    • The contest and these Terms & Conditions shall be governed by and construed in accordance with the laws of India.
